These Terms apply to all orders placed through the BergdorfBio online storefront operated by Bergdorf Bioscience (“we”, “us”). The contractual partner is Bergdorf Bioscience, Bahnhofsgasse 1, 07407 Rudolstadt, Germany (see Impressum for authorized representation).
Unless expressly agreed in writing, your terms and conditions do not apply.
Product presentation in the shop constitutes a non-binding invitation to place an order. By submitting an order you make a binding offer to conclude a purchase contract. We may accept this offer by sending an order confirmation or by shipping the goods, depending on the process implemented in our systems.
We reserve the right to refuse orders (e.g. for legal, compliance or inventory reasons) and will inform you accordingly.
Our products are sold exclusively for in-vitro research and laboratory use by qualified persons. They are not intended for human consumption, cosmetic use, or any application that violates applicable law.
You are responsible for lawful procurement, storage and use in your jurisdiction. By ordering, you confirm that you will use the products only for permitted research purposes.
Prices are displayed in the storefront in the currency associated with the selected sales channel (e.g. EU or US). Statutory value-added tax or other price components are shown as part of the checkout flow where applicable.
If you switch channels or shipping destinations, prices, taxes and availability may change.
Payment is due according to the payment methods offered at checkout. Some payments are processed by external licensed payment service providers or on-ramp partners. You may be redirected to a provider-hosted page; additional verification steps (including identity checks) may apply under the provider’s rules.
Where settlement involves blockchain-based payout rails, transfers may be final and irreversible. Chargeback mechanisms available in traditional card schemes may not apply to those legs.
We do not store full payment card credentials on our servers where processing is delegated to the payment provider.
Delivery periods stated in the shop or on shipping pages are estimates and may vary due to carrier operations, customs or force majeure. Risk passes in accordance with applicable statutory rules for consumer and commercial sales once the goods are handed over to the carrier, unless mandatory law provides otherwise.
Delivery does not use refrigerated or cold-chain transport; standard parcel services apply.
We retain title to the goods until full payment has been received.
There is no entitlement to free return shipping; you generally bear return costs unless mandatory law requires otherwise.
For questions about damaged shipments, incorrect deliveries or other order issues, contact our support at service@bergdorfbio.com. We will review each case and propose a fair resolution within the limits of applicable law.
If a refund is approved, we will use the original payment route where technically possible; if that route is unavailable, we may settle using an equivalent method. Network or provider fees may be deducted where permitted by law.
Statutory warranty rights apply subject to applicable law. We are liable without limitation for intent and gross negligence. For simple negligence we are liable only for breach of material contractual obligations (cardinal duties), limited to foreseeable, typical damage, except where mandatory law imposes stricter liability.
We are not liable for misuse of products outside the permitted research context or for consequential damages excluded by law.
There is no entitlement to free returns or free return shipping. In exceptional cases, we may review a goodwill solution within 14 days of receipt of the goods; please contact us in advance at service@bergdorfbio.com.
Sealed or hygiene-sensitive products may be excluded from returns depending on the individual case.
Information on the processing of personal data can be found in our privacy policy.
The law of the Federal Republic of Germany applies to contracts with entrepreneurs (merchants) and to supplementary questions, excluding the UN Convention on Contracts for the International Sale of Goods, where permissible. If you are a consumer with habitual residence in the EU, mandatory consumer protection laws of your country remain unaffected where they cannot be derogated from by agreement.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
